Man Charged in Fatal Shooting Near Hartington in March Granted Deposition, Waives Right to Speedy Trial

A man charged in a fatal shooting north of Hartington in March has had his motion for deposition granted.

David Phillips Jr, 20, Louisiana, appeared in court Monday, and with his deposition being granted, his defense team has been given a deadline of sixty days to complete his deposition.

Phillips also waved his right to a speedy trial in the process because the deadline of the deposition is past the six-month timeline for a speedy trial.

Phillips is accused of murdering Israel Matos-Colon, 31, Michigan back in March, and faces charges of second-degree murder, possession of a stolen firearm, and use of a deadly weapon to commit a felony.

Phillips’ pretrial will continue after the deposition deadline, and is next scheduled to appear in court on October 23rd at the Cedar County Courthouse.
