Motions for Judgement of Acquittal and a New Trial in the Andrew Jondahl case have been denied.
Jondahl, 41, of Watertown, appeared in court for a status hearing Wednesday where his attorney, Brent Matter, of Vermillion, cited the low and ready position of how Jondahl was carrying the two shotguns during the night he was shot by officers, as well as officer testimony during the trial.
Judge Cheryle Gehring denied both motions.
Jondahl also plead guilty to habitual offender information regarding a prior aggravated assault charge that occurred in Coddington County in 2011.
Since he pled guilty, the two aggravated assault against law enforcement charges that Jondahl was found guilty of last month are now class 1 felonies instead of class 2, upping the maximum sentence of each charge from 25 years to 50 years.
Jondahl is scheduled for sentencing on May 13th in Yankton County at 2 pm.
