City Approves Administrative Inspection Ordinance

The Yankton City Commission has approved passing an ordinance that will, with the approval of a judge give city staff the authority to enter private property for the purpose of assessing whether code violations are occurring.

Community & Economic Development Director Dave Mingo says the burden of proof regarding potential code violations will lie with city staff.

Mingo says while they may be similar, there are differences between an administrative inspection warrant and one used to search for criminal evidence.

Mingo says the state statute the administrative inspections ordinance is based on has been on the books since 1989.
